Haddad v. Wal-Mart: Trial Counsel’s Discussion of this $2 Million Discrimination Verdict

Rick Fradette, Esq. of Manchester, NH and David Belfort, Esq. of Cambridge MA, trial counsel in the landmark Massachusetts gender bias case of Haddad v. Wal-Mart where the employer was forced to pay $2,000,000 to a wrongfully terminated female pharmacist, will discuss their litigation experience against the largest retailer and private employer in the world.  

Rick and Dave will highlight their preparations and trial strategy with an eye towards those management pitfalls and human resource mistakes which contributed to this historic jury verdict.   Come learn how to avoid exposure to claims of discrimination and lawsuits based on impermissible bias from two prominent employment trial attorneys.

Mr. Fradette is a licensed pharmacist and practicing attorney in New Hampshire.  He graduated from the Massachusetts College of Pharmacy in 1977 and the Franklin Pierce Law in 1982.  In 2000 he earned a Masters in Public Health from Boston University.  His areas of practice are professional malpractice, including medical, pharmacy, legal, and other learned professions, and employment law representing employees and employers.  He was successful in winning a $1.8 million malpractice verdict for a stroke victim following cardiothoracic surgery at an Ivy League teaching hospital and a $375,000 verdict for a phlebotomist against a community hospital.  In employment law, he won a $2 million verdict for a female pharmacist for gender discrimination and a $480,000.00 verdict against a New Hampshire employer for wrongful termination.  He has successfully pursued legal malpractice claims on behalf of business and individual clients, recovering over $1.5 million.  He is a Board Certified Civil Trial Attorney and devotes the majority of his time to complex jury trials.

Mr. Fradette donates his time and talent to professional and community affairs by serving on various community boards and professional associations.  In 2007, 2008 and again in 2009 he was selected as a member of the New England Super Lawyers in the area of Professional Liability.  In 2008 he was appointed Adjunct Professor of Health Law at the Franklin Pierce Law Center.  He and his wife have three adult children.

Attorney Belfort is a founding member and managing principle of Bennett & Belfort, P.C.,  Mr. Belfort’s practice is focused on civil litigation, concentrating on employment and business matters. He currently represents a number of individual and institutional clients before both judicial and administrative tribunals, including the Massachusetts Commission Against Discrimination, The Equal Employment Opportunity Commission, and the Department of Employment and Training.
 
Mr. Belfort is an active member of the Massachusetts Bar Association, where he served as co-chair of the Labor and Employment Section Counsel from 2007 to 2009.  He is currently the liaison to the Attorney General’s office and co-heads the Annual Labor and Employment annual conference committee.  He is also a member of the Massachusetts Employment Lawyers Association and Health Law Advocates, a pro bono advocacy organization aimed at improving access to health care.
 
Mr. Belfort is licensed to practice law in the Commonwealth of Massachusetts and in the District of Columbia, with privileges in both state and federal courts.  Attorney Belfort obtained his B.A., with honors, from Hobart College in 1992 with a concentration in Political Science and Economics.  He received his J.D. from Pierce Law in 1996.
 
Mr. Belfort served as co-counsel in the case of Haddad v. Wal-Mart Stores, Inc. in which he, along with Rick Fradette, helped their client, Cynthia Haddad, secure a $2 million gender discrimination verdict in June, 2007.  In October, 2009 the verdict was upheld in a unanimous Massachusetts Supreme Judicial Court decision.  Ms. Haddad's verdict was the largest Massachusetts discrimination verdict reported in 2007.
