Data Security Protection and Compliance - What You Need to Know to Ensure Your Company is in Compliance

Data security protection erupted upon certain businesses ten years ago with the passage of a federal law known as the Gramm-Leach-Bliley Act.  Since then, numerous federal agencies and states have passed increasingly comprehensive and complex legislation and regulations to combat the ongoing threat to "personal information."  These laws and regulations now require compliance in some manner upon every business entity. 
 
Federal law includes HIPAA, HITECH and FTC's Red Flag Rules, and nearly every state has enacted breach notification laws.  The laws require certain entities to protect personal information and personal health information, and require notification to individuals when unauthorized access to that information occurs.  The increasing demand on employers has continued with the enactment of law that requires certain businesses to actually detect the "red flags" of identity theft and implement strategies to mitigate the risk.  Additionally, Massachusetts has enacted regulations requiring all companies engaged in commerce to protect personal information of Massachusetts residents with implementation of a specific written information security program. 
 
As a result, protection of data security and reaction to data security breaches have become more significant issues for employers, managers and human resources professionals.

This program will provide you with an overview of the various data security laws, how to bring your company into compliance with Massachusetts' new data security regulations, how to comply with the FTC Red Flag Rules, and how to respond appropriately in the increasingly likely event that your company experiences a data security breach. 

 

About our Speakers:

Neil Nicholson is an associate in McLane's litigation department.
