Overview of Important Legal Decisions
and Legislative Changes of 2005

Prepare for 2006 with an overview of the most critical court decisions and legislative changes in federal,

Massachusetts and New Hampshire employment law during the past year.  Topics covered in this presentation will include age discrimination; affirmative action; sexual harassment; the Americans with Disabilities Act; independent contractor status; wage and hour issues; new U.S. Supreme Court decisions about age discrimination, an employers’ obligations to pay wages for time spent “donning and doffing” protective gear, and clarification of the new Fair Labor Standards Act regulations, the Fair Credit Reporting Act, identity theft protections, the new USERRA regulations and military service as a protected category, as well as significant developments in immigration laws.  

This interactive session will include handouts, a PowerPoint outline, sample policies and forms you can take away and begin using immediately.  There will also be a breakout session on new Massachusetts and New Hampshire specific developments.

New resources available from the Equal Employment Opportunity Commission, United States Department of Labor, Citizen and Immigration Service, and Federal Emergency Management Agency that can help your business comply with wage and hour laws, health and safety standards, family and medical leave, whistleblower protection, disaster planning, new I-9 forms, cancer as a disability, and those “associated” with someone with a disability.
  2. New USERRA regulations and how to modify your military leave polices
  3. Background investigations and how to do them within the law
  4. Changes in the drafting of confidentiality policies and employment agreements that have confidentiality provisions
  5. Sexual harassment update, including workplace favoritism, dating and nepotism issues, and hostile behavior
  6. Age discrimination, and how to avoid making employment decisions that negatively impact older workers
  7. Working at home as an accommodation under the Americans with Disabilities Act
  8. New data about a “motherhood penalty,” pregnancy discrimination, and equal pay
  9. NH specific issues: new statutes about companies that layoff or have certain vacation shutdowns and their obligations to file a report with the Department of Employment Security; several new wage and hour changes that demand closer attention to pay practices and handbook polices; new crime victims leave of absence law, that compels employers to draft a handbook policy addressing it.

Presenters Biography:


Julie Moore is president and founder of Employment Practices Group.  She received her B.A. degree, summa cum laude, from Boston College and her J.D. degree, cum laude, from Suffolk University Law School.  Ms. Moore has spoken on employment issues for such organizations as the Massachusetts Bar Association, New Hampshire Bar Association, the Society for Human Resources Management, Merrimack Valley Human Resources Association, Northeast Human Resources Association, and National Human Resources Association, among others.  She is a frequent author, lecturer, and trainer on workplace issues.  Ms. Moore previously wrote on a monthly basis for the New Hampshire Business Review, and has frequently published articles in regional publications.  She is on the faculty for Franklin Pierce College's accredited programs on employment law.  She is a member of the Massachusetts, New Hampshire, and American Bar Associations, the National Human Resources Associations (New Hampshire Affiliate),, the Merrimack Valley Human Resources Association, and the Society for Human Resources Management.
