Topic: The Art of the Deal: Negotiating Severance Agreements

Whether your organization routinely offers severance packages to terminated employees or only does so when “problem” employee situations present a risk of liability, a legally compliant and enforceable agreement is essential.

This interactive presentation, based on a hypothetical situation, will address the severance negotiation process from the employer’s and employee’s perspectives, and examine common strategies used by human resources professionals and their legal counsel to gain a tactical advantage. General negotiation and mediation strategies will also be discussed, as well as the elements of a legally compliant agreement.

The presenters are Jeanne R. Colacchio, Jeanne M. Colachico, Esquire and Associates, North Andover, Massachusetts, and Scott Flegal, Nashua, New Hampshire.

 

 

 

Information about our speaker:

Jeanne M. Colachico heads a legal/human resources management consulting firm in North Andover, MA, Jeanne M. Colachico, Esquire & Associates, offering advice on employment matters, internal investigations, workplace assessments, general management and employment-related training, affirmative action plans, HR strategic planning and implementation, employee handbooks, and executive coaching.

Prior to 2000, Jeanne held senior legal and HR management roles for 25 years at FleetBoston Financial Group, Arthur D. Little, Textron, U.S. Department of Defense, and Massachusetts Department of the Attorney General.

She holds a B.A. (Regis College (magna cum laude)), M.A.( Boston University), J.D.(Suffolk University School of Law), a Certificate, Business Administration (Babson College), and is a member of the Massachusetts Bar.

Fluent in Spanish, proficient in French and Italian, she has published numerous employment articles, has spoken on these issues nationally, and provides training in English and Spanish.

Scott Flegal is a lawyer, mediator and consultant whose practice is in Nashua, New Hampshire. Mr. Flegal has been a practicing business lawyer for twenty two years. His law practice is a niche firm representing entrepreneurs and businesses of various shapes and sizes. Mr. Flegal also provides conflict consulting services through his affiliate, Business Mediation Solutions, LLC. He is a court-appointed mediator in New Hampshire and was recently appointed by the New Hampshire Supreme Court to serve on the New Hampshire Judicial Branch Dispute Resolution Committee. He has studied mediation and advanced negotiation at the Harvard Law School Program of Instruction for Lawyers. He is the author of “Advocating for Understanding – Why the Understanding-based Mediation Model Works,” which was published in the summer, 2005 edition of the New Hampshire Bar Journal. Mr. Flegal’s unique problem-solving approach to the practice of law earned him the 2003 New Hampshire Business Review Excellence Award for excellence in the field of law. He was the recipient of the Greater Nashua Chamber of Commerce Business Person of the Year award in 2003.
