Navigating the Independent Contractor Abyss: A Compass for Lawful Worker Classification

Who can lawfully be classified as an independent contractor? Many federal and state statutes address this issue, but fail to provide clear guidelines for employers seeking to determine whether a worker should be classified as an "employee" or "independent contractor." While the Internal Revenue Service has historically provided guidance with its "20-factor test," many states, including Massachusetts, have enacted much broader "ABC" or "three-factor" tests that employers must satisfy in order to overcome the presumption that a worker is an employee. This presentation will summarize various independent contractor laws, including the laws in both Massachusetts and New Hampshire, highlight the available guidance and resources, provide an update on recent case law and legislation, offer a compliance checklist and explore the particular challenges confronting multi-state employers.
